Store Regulations
These Regulations are the Regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended), and also regulate the conditions for concluding Sales Agreements on the Website, in accordance with the content of other acts that regulate this obligation accordingly.

The entity indicated above, which is the Owner, Seller, and Administrator, has the exclusive right to operate the Website.

The Website operates in accordance with applicable law and good business practices, particularly with regard to e-commerce standards regarding the quality of goods and the handling of transactions.
Definitions:
Regulations – these Regulations together with annexes, informing about the obligations and rights of the Parties to the Agreement,
Party – a party to the Agreement is the Customer or Seller – in the case of the
term Party – this shall be understood as the Customer and the Seller jointly,
Distance Contract – a contract concluded with the Customer as part of an organized system of concluding distance contracts, without the simultaneous physical presence of the Parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract,

Customer – a natural person, legal person or organizational unit without legal personality, to which the law grants legal capacity, purchasing products or services via the Website,
Consumer – a natural person purchasing products or services via the Website for purposes not directly related to their business or professional activity,
User – any entity using the Website,
Account – User panel available immediately after the payment is credited. The panel is accessible after logging in using a designated password sent to the email address.
Payment method – the form of payment for the ordered product or service, selected by the Customer when placing the order, offered by the Website or as a result of individual arrangements with the Website in a form other than the payment methods presented on the website.
Paragraph 1 General Provisions
The subject of the Website’s activity is the sale of interior design PRODUCTS. In matters not regulated by these Terms and Conditions, the relevant provisions of law in force in the territory of the Republic of Poland will apply, in particular the Act of 23 April 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended), the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014 item 827) and the Act of 29 August 1997 on Personal Data Protection (consolidated text: Journal of Laws of 2002 No. 101, item 926, as amended). The content on the Website describing training and services offered by the Service Provider does not constitute a commercial offer within the meaning of the Civil Code. The price list on the Website’s home page does not constitute a commercial offer within the meaning of the Civil Code.
Paragraph 2: Ordering Procedure and Contract Conclusion:
The Customer may place orders on the website 24 hours a day, 7 days a week, via the website boldandpanache.com. The Website conducts sales within the territory of the Republic of Poland and abroad. Information about products and services presented on the Website constitutes commercial information within the meaning of the Civil Code.
Placing an order constitutes an offer, within the meaning of the Civil Code, made by the Customer to the Seller. To place an order, the Customer should use the online store available at https://boldandpanache.com/. After placing a valid order, the order is considered placed. Orders placed in the above-mentioned manner are confirmed by email. The moment the contract is concluded is the moment the customer receives a return confirmation of order acceptance. From the moment the funds are credited to our bank account, the package will be shipped to the Customer’s address provided in the form within 7 days. The date of performance of the contract concluded through our Online Store is the date the ordered goods are shipped to the Customer.
Paragraph 3: Payments:
All prices presented on the Website are gross prices, expressed in Polish zloty, and include value added tax (VAT), as defined by separate regulations. The Website accepts the following payment methods: a) Online payment via Dotpay, b) Bank transfer, c) PayPal. The Customer places an order at the prices in effect at the time of order placement. The Website reserves the right to change prices. This provision does not apply to orders already in progress.
Paragraph 4 Complaints Procedure.
All complaints related to the provision of Services via the Website and questions regarding the use of the Website should be submitted to the following email address: contact@boldandpanche.com. A properly submitted complaint should, at a minimum, include the Customer’s identification (first name, last name, address, email address, and telephone number) and a description of the fact or service being complained
about. If the data or information provided in the complaint requires supplementation, the Service Provider will request supplementation from the complainant before considering the complaint. The time required for the Website to provide additional explanations extends the complaint review period. In the case of contracts concluded with Consumers, the Website is liable to the Consumer under the terms of Article 556 et seq. of the Civil Code for physical or legal defects (warranty). The Website will respond to the Consumer’s complaint within 14 (fourteen) days. Otherwise, the Seller will be deemed to have deemed the Consumer’s statement or request justified. If a Customer who is a Consumer requests a replacement service or submits a price reduction request specifying the amount by which the price is to be reduced, and the Service Provider fails to respond to this request within fourteen days, the request is deemed to have been justified. In the case of contracts concluded with Customers who are not also consumers, pursuant to Article 558 § 1 of the Civil Code, the Service Provider’s liability under warranty is excluded.
Paragraph 5. Withdrawal from the contract, termination of use.
Pursuant to Article 27 of the Consumer Rights Act, a Consumer who has concluded a distance contract may withdraw from it without giving any reason and without incurring any costs, except for the costs specified in Articles 33, 34, and 35 of the Consumer Rights Act, by submitting an appropriate written declaration within fourteen days of the date of delivery of the subject of the contract. To meet this deadline, it is sufficient to send the declaration before its expiry. The declaration can be sent electronically or to the delivery address. The declaration can be submitted on the form attached to these Terms and Conditions. The User may terminate the use of the Website at any time. The Seller reserves the right to suspend the operation of the Website at any time and for any reason, as well as the right to modify or terminate the provision of Services via the Website.
Paragraph 6: Technical Requirements and Information about Cookies.
Recommended technical requirements for use with the IT system include: a computer with internet access, email access, and a web browser. The website uses cookie technology. Cookies (also known as “cookies”) constitute IT data, particularly text files, stored on the User’s end device and intended for use with the Website. The files indicated in point 1 allow the User’s device to be recognized and the website to be displayed appropriately, tailored to their individual preferences. The Website uses various types of cookies, including: Persistent cookies, which are stored on the end device for the period specified in the file’s parameters or until the User deletes them. Temporary cookies, which are deleted at the end of the session, i.e., logging out of the website, leaving the website, or closing the web browser that displays the website. First-party cookies, which are placed on the website by the owner. Third-party cookies, which are placed on the website by third parties, e.g., to conduct anonymous statistics through Google Analytics. Paragraph 7 Final Provisions
The Service Provider reserves the right to make changes to the content on the Website and to make any changes to the price list for training and services offered through the Website, depending on changing average market rates. The Service Provider is not liable for: a) any damage caused by Users’ infringement – in connection with their use of the Website – of third-party rights; b) damage resulting from disruptions in the operation of the Website or its unavailability, caused by reasons beyond the Service Provider’s control or which occurred as a result of events that the Service Provider was unable to prevent; c) any other damage caused by the User’s failure to comply with the provisions of these Terms and Conditions. These Terms and Conditions may be amended after Users have been informed of the scope of the anticipated changes no later than 14 days before their effective date. Orders placed during the validity of the previous version of the Terms and Conditions will be fulfilled in accordance with their provisions. Any disputes arising between the Seller and the Customer who is a Consumer will be resolved by a common court with jurisdiction in accordance with the provisions of the Code of Civil Procedure. Any disputes arising between the Seller and the Customer who is not a consumer will be resolved by a common court having jurisdiction over the registered office of the Website.

All materials contained on the Website are subject to copyright and are protected by law. Their use and distribution without the consent of the Website owner is prohibited. These Terms and Conditions are effective from January 25, 2022. In the event of a dispute with the Seller, the Consumer has the option of amicably resolving the matter by: a) contacting a permanent consumer arbitration court, b) mediation, c) contacting the provincial inspector of the Trade Inspection, d) obtaining free assistance in resolving the dispute from the Consumer Federation using the toll-free consumer hotline at 800 007 707.
