Terms and Conditions
These Terms and Conditions constitute the regulations referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended), and also regulate the conditions for concluding Sales Agreements in the Service, in accordance with the content of other acts appropriately regulating this obligation.
The Service is operated by Natalia Malarska, conducting business under the name: NATALIA MALARSKA la folie studio projektowe, ul. Antoniego Bohdziewicza 25, 01-685 Warsaw, Tax ID (NIP): 6932087942, Business Registry Number (REGON): 362846966.
The exclusive right to operate the Service belongs to the entity indicated above, which is the Owner, Seller, and Administrator of the Service.

The Service operates based on applicable legal regulations and with respect for good practices in business transactions, in particular taking into account e-commerce standards regarding the quality of goods and handling of transactions.
Definitions:
Terms and Conditions – these Terms and Conditions together with appendices, informing about the obligations and rights of the Parties to the Agreement
Party – a party to the Agreement is the Customer or the Seller – in the case of the concept of Parties – the Customer and Seller together
Distance contract – a contract concluded with the Customer as part of an organized distance contract system, without the simultaneous physical presence of the Parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract

Customer – a natural person, legal entity, or organizational unit without legal personality to which the law grants legal capacity, purchasing products or services through the Service
Consumer – a natural person purchasing products or services through the Service for purposes not directly related to their business or professional activity
User – any entity using the Service
Account – User panel available immediately after payment is credited. Panel accessible after logging in with the designated password sent to the email address
Payment method – form of payment for an ordered product or service, selected by the Customer when placing an order offered by the Service or as a result of individual arrangements made with the Service in a form other than the payment methods presented on the website
§ 1 General Provisions
The subject of the Service’s activity is the sale of interior furnishing PRODUCTS. In matters not regulated by these Terms and Conditions, the relevant legal provisions applicable in the territory of the Republic of Poland shall apply, in particular the Act of April 23, 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended), the Act of May 30, 2014 on consumer rights (Journal of Laws 2014, item 827), and the Act of August 29, 1997 on the protection of personal data (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended). The content found in the Service, describing training and services offered by the Service Provider, does not constitute a commercial offer within the meaning of the Civil Code provisions. The price list on the Service’s main page does not constitute a commercial offer within the meaning of the Civil Code provisions.
§ 2 Order Placement Procedure and Moment of Contract Conclusion
Customers can place orders in the service 24 hours a day, 7 days a week through the website boldandpanache.com. The Service sells within the territory of the Republic of Poland as well as abroad. Information about products and services presented on the Service’s websites constitutes commercial information within the meaning of the Civil Code provisions.
Placing an order constitutes an offer within the meaning of the Civil Code, submitted to the Seller by the Customer. To place an order, the Customer should use the e-shop available at https://boldandpanache.com/. After placing a valid order, the order is considered placed. Orders placed in the above manner are confirmed by email. The moment of contract conclusion is therefore considered to be the sending of feedback to the Customer confirming acceptance of the order. From the moment funds are credited to our bank account, within 7 days the package will be sent to the Customer’s address provided in the form. The day of performance of the Agreement concluded through our Online Store is the day the ordered goods are sent to the Customer.
§ 3 Payments
All prices presented in the Service are gross prices, expressed in Polish zloty, including value-added tax (VAT), specified by separate regulations. The Service provides the following types of payment: a) Online payment through Dotpay service b) Bank transfer c) PayPal
The Customer places an order according to the prices in effect at the time the order is placed. The Service reserves the right to change prices. This provision does not apply to orders already being fulfilled.
§ 4 Complaint Procedure
All complaints related to the provision of Services through the Service and questions regarding the use of the Service should be submitted to the email address: contact@boldandpanche.com. A properly filed complaint should at least include the Customer’s identification (name, surname, residential address, email address, contact phone number), description of the complained fact or service. If the data or information provided in the complaint requires supplementation, the Service Provider, before considering the complaint, requests the complainant to supplement it. The time for providing additional explanations by the Service extends the period for considering the complaint.
In the case of contracts concluded with Consumers, the Service is liable to the Consumer on the terms specified in Article 556 and subsequent articles of the Civil Code for physical or legal defects (warranty). The Service will respond to the Consumer’s notification within 14 (fourteen) days. Otherwise, it is considered that the Seller has recognized the Consumer’s statement or request as justified. If the Customer who is a Consumer has requested a replacement of the service or made a statement about a price reduction, specifying the amount by which the price is to be reduced, and the Service has not responded to this request within fourteen days, this request is considered justified. In the case of contracts concluded with Customers who are not consumers, pursuant to Article 558 § 1 of the Civil Code, the Service’s liability under warranty is excluded.
§ 5 Withdrawal from the Contract, Termination of Use
A Consumer, pursuant to Article 27 of the Consumer Rights Act, who has concluded a distance contract may withdraw from it without giving a reason and without incurring costs, with the exception of costs specified in Articles 33, 34, and 35 of the Consumer Rights Act, by submitting an appropriate written statement within fourteen days from the day the subject of the contract is delivered. To meet this deadline, it is sufficient to send the statement before its expiration. The statement can be sent electronically or to the delivery address. The statement may be made on a form which constitutes an Appendix to these Terms and Conditions. The User may at any time resign from using the Service. The Seller reserves the right to suspend, at any time and for any reason, the Service’s operation, as well as the right to modify or terminate the provision of Services through it.
§ 6 Technical Requirements and Information About Cookies
Recommended technical requirements for cooperation with the IT system are: computer with Internet access, access to email, web browser. The Service uses cookie technology. Cookies (also called “cookies”) constitute IT data, in particular text files, which are stored on the User’s end device and are intended for use with the Service’s website. The files indicated in point 1 allow recognition of the User’s device and appropriate display of the website adapted to their individual preferences. Within the Service, various types of cookies are used, which are:
Persistent cookies – cookies whose storage period on the end device lasts for the time specified in the given file’s parameters or until the User independently deletes the cookies.
Temporary cookies – cookies that are deleted when the so-called session ends, i.e., logging out of the website, leaving the website, or closing the web browser that displays the website.
First-party cookies – cookies placed on the website by the owner.
Third-party cookies – cookies placed on the website by external entities, e.g., for conducting anonymous statistics by Google Analytics.

§ 7 Final Provisions
The Service Provider reserves the right to make changes to the content found in the Service and to possible changes in the price list of training and services offered through the Service, depending on changing average market rates. The Service Provider is not liable for: a) any damage caused by Users’ violation of third party rights in connection with the use of the Service; b) damage resulting from disruptions in the operation of the Service or its unavailability, caused by reasons beyond the Service Provider’s control or that occurred as a result of events that the Service Provider was unable to prevent; c) any other damage caused by the User’s failure to comply with the provisions of these Terms and Conditions.
Changes to the content of these Terms and Conditions may occur after prior notification to Users about the scope of anticipated changes no later than 14 days before the day they take effect. Orders placed during the validity of the previous version of the Terms and Conditions will be fulfilled in accordance with its provisions. Any disputes arising between the Seller and a Customer who is a Consumer will be resolved by a common court with jurisdiction in accordance with the provisions of the Code of Civil Procedure. Any disputes arising between the Seller and a Customer who is not a consumer will be resolved by a common court with jurisdiction based on the Service’s registered office.

The Customer can access these Terms and Conditions at any time via a link posted on the Service’s main page.
All materials found in the Service constitute the subject of copyright and are legally protected. Using and distributing them without the consent of the Service owner is prohibited. These Terms and Conditions are effective from January 25, 2022. In the event of a dispute with the Seller, the Consumer has the option of amicable settlement of the matter by: a) turning to a permanent consumer arbitration court b) mediation c) turning to the provincial inspector of the Trade Inspection d) obtaining free assistance in resolving the dispute from the Consumer Federation using the free consumer hotline 800 007 707.
